Terms of Service

1. Agreement to these terms
These Terms of Service (the “Terms”) form a binding agreement between you and PostFuze (“PostFuze,” “we,” “us,” or “our”) and govern your access to and use of the PostFuze website, dashboard, REST API, Model Context Protocol (MCP) server, and related services (together, the “Service”). By creating an account, clicking “I agree,” or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are entering into these Terms on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
2. Definitions
- “Service” means the PostFuze publishing platform, including the composer, scheduling, calendar, REST API, MCP server, webhooks, and documentation.
- “Account” means the PostFuze account through which you access the Service, including your organization and any API keys issued to it.
- “Connected Account” means a third-party social-media account (for example, X, LinkedIn, Instagram, or TikTok) that you authorize PostFuze to access on your behalf.
- “Customer Content” means the posts, captions, media, comments, schedules, and other materials you submit, upload, or publish through the Service.
- “Third-Party Platform” means any social network or external service that PostFuze integrates with to publish or retrieve content.
3. Accounts and eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. You agree to provide accurate, complete information when creating your Account and to keep it up to date. You are responsible for safeguarding your credentials and API keys, and for all activity that occurs under your Account. Treat API keys as secrets: do not embed them in client-side code or public repositories. Notify us promptly at [email protected] if you suspect unauthorized use.
4. The Service and social-platform connections
PostFuze lets you compose once and publish, schedule, and fan content out to multiple Connected Accounts through a single interface or API call. To do this, you authorize PostFuze to connect to Third-Party Platforms on your behalf via OAuth or other supported authentication, and to publish, retrieve status for, and read limited analytics about the content you direct it to handle. You may connect your own platform applications (bring-your-own OAuth) where supported. You can revoke a connection at any time from your dashboard or from the Third-Party Platform itself; revoking a connection may prevent scheduled posts to that account from being published.
5. Acceptable use
You agree not to use the Service to, and not to permit anyone using your Account to:
- violate any applicable law or the terms, policies, or rate limits of any Third-Party Platform;
- publish content that is unlawful, infringing, defamatory, deceptive, or that constitutes spam, malware, or platform manipulation;
- send unsolicited bulk messages or engage in inauthentic, coordinated, or automated behavior prohibited by a Third-Party Platform;
- attempt to gain unauthorized access to the Service, other users’ data, or our systems, or to probe, scan, or test their vulnerability;
- reverse engineer, resell, or build a competing service from the Service except to the extent this restriction is prohibited by law;
- exceed documented rate limits, circumvent usage metering, or otherwise impair the integrity or performance of the Service.
We may suspend or limit access to investigate suspected violations or to protect the Service, you, or third parties.
6. Plans, billing, and usage-based fees
The Service is offered on a pay-as-you-go basis. The base subscription is billed monthly and includes a set number of published posts; posts beyond that allowance are billed per post as published usage. A “post” is counted per target Connected Account. Current pricing is shown on our pricing page and is incorporated into these Terms by reference. Fees are stated in U.S. dollars, are exclusive of taxes, and are non-refundable except where required by law. We may change pricing on a prospective basis with reasonable notice; continued use after a change takes effect constitutes acceptance. You authorize us and our payment processor to charge your payment method for all fees and applicable taxes. Late or failed payments may result in suspension.
7. Customer Content and your responsibilities
You retain all ownership of your Customer Content. You grant PostFuze a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, format, and publish your Customer Content solely as needed to operate and provide the Service at your direction — including delivering it to the Connected Accounts and Third-Party Platforms you select. You represent and warrant that you own or have all rights necessary to your Customer Content, that publishing it does not infringe any third party’s rights, and that it complies with these Terms and the rules of each Third-Party Platform to which you publish it. You are solely responsible for your Customer Content and for the schedules, accounts, and destinations you configure.
8. Third-party platforms and their terms
The Service interoperates with Third-Party Platforms such as X, LinkedIn, Instagram, TikTok, YouTube, Facebook, Threads, Bluesky, Pinterest, Google Business, and Reddit. Those platforms are operated by third parties under their own terms, developer policies, and privacy practices, and your use of them is governed by those terms in addition to these Terms. PostFuze does not control Third-Party Platforms and is not responsible for their availability, behavior, changes to their APIs, content-moderation decisions, or for any suspension or termination of your Connected Accounts by them. A Third-Party Platform may change, deprecate, rate-limit, or remove functionality at any time, which may affect the Service’s ability to publish on your behalf.
9. Intellectual property
The Service, including its software, APIs, documentation, design, and the PostFuze name and logos, is owned by PostFuze and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes. We welcome your feedback and may use it without restriction or obligation to you. Except for the rights expressly granted here, no rights are transferred.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that any post will be delivered or published at a particular time, or that the Service will be compatible with every Third-Party Platform at all times. Scheduling and delivery depend on Third-Party Platforms that are outside our control.
11. Limitation of liability
To the maximum extent permitted by law, PostFuze and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to the Service or these Terms, even if advised of the possibility of such damages. Our total aggregate liability for all claims relating to the Service will not exceed the greater of the amounts you paid to PostFuze for the Service in the three (3) months immediately preceding the event giving rise to the claim, or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnity
You agree to defend, indemnify, and hold harmless PostFuze and its officers, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your Customer Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party, including any Third-Party Platform.
13. Termination
You may stop using the Service and close your Account at any time from your account settings. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or others. Upon termination, your right to use the Service ceases, scheduled posts may not be published, and we may delete your Customer Content in accordance with our Privacy Policy and our retention practices. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnity, and governing law — will survive.
14. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting the updated Terms with a new “Last updated” date or by notifying you through the Service. Changes take effect when posted unless stated otherwise, and your continued use of the Service after that constitutes acceptance of the revised Terms.
15. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You and PostFuze agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not subject to arbitration or a small-claims forum, to the extent permitted by applicable law in your jurisdiction.
